Financial Contributions Towards Your Children: Navigating Maintenance & the CMS

Depending on your situation, it is entirely feasible to arrange financial matters — including ongoing contributions towards the care of your children — directly between you and your ex-partner without statutory intervention.

While informal, family-based arrangements are often the healthiest route, it is sensible to document the terms in writing and have them signed by both parties (ideally in front of a witness) so expectations are clear from day one. However, many parents end up using the Child Maintenance Service (CMS). The statutory system is notoriously rigid, slow, and frequently in the headlines for administrative bottlenecks that leave both paying and receiving parents frustrated.

1. Income Verification

  • Maintain an objective, dated 12-month overnight ledger or have your formal Child Arrangements Order (CAO) ready, as the CMS cross-references your claimed overnights with the other parent.

4. Special Expenses & Cost of Contact (Variations)

  • If you spend more than £10 per week directly on travel costs to maintain regular contact with your child (fuel, train fares, or necessary travel accommodation), you can apply for a Special Expenses Variation.

  • If approved, the CMS deducts qualifying contact travel costs directly from your gross income before calculating your maintenance liability.

Challenging an Inaccurate Assessment

The CMS is an administrative body that processes calculations using automated data feeds, which means errors happen frequently. If you believe an assessment is incorrect:

  1. Request a Mandatory Reconsideration: You have the right to ask the CMS to formally look at their decision again within one month of the notice date. State clearly what factual data (income, overnights, or expenses) was miscalculated and supply indexed supporting evidence.

  2. Escalate to an Independent Tribunal: If the Mandatory Reconsideration does not resolve the error, you have the right to appeal the decision to the Social Security and Child Support Tribunal (First-tier Tribunal), which is entirely independent of the CMS.
