Terms & Conditions
These terms apply to any session, document review, or digital product purchased from Navigating Separation ("the Practitioner"), operated by Mark Watson.
1. Nature of the Service
The Practitioner provides practical strategy guidance, communication coaching, and litigant support based on lived experience of the UK family court and Child Maintenance Service systems. This is not legal advice, not regulated legal representation, not accredited counselling or psychotherapy, and not family mediation. Nothing provided should be relied upon as a substitute for advice from a qualified solicitor, regulated mediator, or accredited therapist, and the Client is encouraged to seek such advice where appropriate.
2. Scope and Limits
The Practitioner provides support in the capacity of an informal mentor or lay assistant (McKenzie Friend principles) and does not conduct litigation or manage formal court filings on the Client's behalf. The Practitioner does not have an automatic right of audience in court and cannot speak on the Client's behalf in proceedings unless a Judge grants permission on the day. The Practitioner will not draft formal legal pleadings, provide statutory calculations as a substitute for CMS or HMRC determinations, or advise on matters requiring regulated solicitor accreditation.
3. Fees and Payment
Fees are payable in full at the time of booking via the payment provider used on the booking page. Prices are as published at the time of booking and may change for future bookings without notice.
Document Review fees are charged per page (as stated on the booking page) and quoted to the Client before work begins once the document has been received. For Hearing-Day Support bookings, travel time, mileage, and — where the hearing location requires an overnight stay — accommodation, are not included in the quoted fee and are charged separately at cost. These additional costs are agreed with the Client in writing before the booking is confirmed.
4. Cancellation, Refunds, and Rescheduling
Live Sessions: Live sessions may be rescheduled or cancelled free of charge with at least 2 business days' notice by email. Cancellation with less than 2 business days' notice, or non-attendance, forfeits the session and payment. There are no refunds on single-session bookings once the session has started. For multi-session bundles, any full unused sessions may be refunded in line with these terms; sessions already completed are non-refundable.
Document Reviews: Document reviews are non-refundable once the document has been submitted, as review work commences upon receipt.
Digital Products: In accordance with the Consumer Contracts Regulations 2013, by purchasing and downloading any digital product (including PDF guides, spreadsheets, or templates), the Client consents to immediate digital supply and acknowledges that their statutory 14-day right of cancellation is waived once file access or download begins.
5. Confidentiality and Data
Information shared by the Client is kept strictly confidential and will not be disclosed to any third party, including a former or current partner, without the Client's explicit written consent. This is subject to the sole exception where the Practitioner reasonably believes there is an imminent risk of serious harm to a child or vulnerable adult, in which case the Practitioner reserves the right to contact relevant safeguarding authorities. 6. Limitation of Liability
The Practitioner provides guidance in good faith based on personal experience and knowledge of the practical administrative systems described, but accepts no liability for outcomes in the Client's legal proceedings, CMS assessments, or personal circumstances. The Practitioner's total aggregate liability under this agreement is strictly limited to the total fees paid by the Client for the specific service or product in question.
7. Complaints and Insurance
Any concerns regarding the service should be raised directly with the Practitioner in the first instance at mark@navigatingseparation.com . The Practitioner holds relevant Professional Indemnity and Public Liability insurance.
8. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales.
